Terms of Service

SuperDuper Scoopes is an independently owned and operated business (“us,” “we” or “our”) that provides pet-waste removal services to residences, businesses and commercial properties, you agree to the following terms of service (“Terms”) that govern the sales and services provided by us (“Services”). By accepting the Services you hire us for, you are bound to these Terms.

The customer understands our ability to provide the Services can be dependent on weather, condition of grass height, access to your yard which is your own responsibility, and other unknown outside influences. By initiating service, you agree to the listed service terms and conditions and give Super Scoopers permission to enter your premises and perform services. Super Scoopers does not assume any liability for damage made to gates, yards, pets or any other property, persons, or possessions.

DOG WASTE REMOVAL SERVICE Super Duper Scoopers offers residential and commercial pet waste removal services. These services include One Time Clean, Weekly Cleaning, Every Other Week (Bi-Weekly) Cleaning, and Seasonal Cleaning. All pricing is based on an area size of an 1/10th of an acre. Larger areas will have an additional charge up to and including:

ACCESSING YOUR YARD The Customer understands that if Super Duper Scoopers can’t access the area needing cleaning due to locked/blocked/frozen gates or dogs in the yard; the scoop will be skipped and charges will still apply as the quantity of waste is still accumulating. This means the customer will still pay for the previous missed clean and the next scheduled clean at the appropriate clean. If the customer requests we come back, a $15 driving fee will be added to the customer’s bill.

WEATHER Super Duper Scoopers will work through the rain and cold as long as we can safely do so. The customer understands we cannot work through severe thunderstorms, high winds, extreme high or low temperatures, flooding or an accumulation of snow. Severe weather may make it hazardous for our scoopers to be outside to complete all scheduled visits for a day. When this occurs, you will be notified by our team if your cleaning will be missed. Missed scoops will be rescheduled if possible. Regular service charges will still apply as your pet(s) are occupying the space and depositing waste.

HOLIDAYS Super Duper Scoopers is a family owned and operated business. We value time with friends and family. Holidays give us time to recharge and be with family that's why Super Duper Scoopers does not provide services on the following holidays/ Holiday Weekends: Easter (Weekend), Memorial Day (Weekend), 4th of July, Labor Day (Weekend), Thanksgiving Day, Christmas Eve and Christmas Day and New Year’s Day. If your pick up day falls on one of these days, we will reschedule your cleaning. Services will only be charged if we perform services.

BILLING As a client of Super Duper Scoopers you must have a valid credit card on file, no exceptions. If the customer's card is declined, we will discontinue service immediately until the issue has been resolved. If a clean is missed/skipped due to an unpaid invoice, the customer will still be charged for the skipped service as the level of waste is still accumulating between servicing. If more than 14 days have passed since your last clean up, a first time clean up fee will be applied. We will only pause service for periods of up to 30 days.

One Time Cleanings will be billed after the service has been completed. Payment is due immediately. If payment becomes more than 30 days late Super Duper Scoopers will turn your account over to collections. To terminate service, please email service.superduperscoopers@gmail.com or call (681) 248-0669. Upon termination notification, your card will be charged for any outstanding balances (if applicable).

Same day service cancellations initiated by the customer will be charged a $50.00 fee- no exceptions. All invoices are due on the date provided in the invoice. Any services provided by Super Dupers Scoopers will cease for delinquent accounts or invoices not paid. Reminders will be sent at least 1 day prior to invoice due date. There are no exceptions unless customer(s) have agreed to a customized payment schedule prior to the invoice due date. A late fee of $15.00 will be applied to an account starting the day after the invoice Due Date and continue to be applied every 7 days until the outstanding balance has been paid.

LEAVES, DEBRIS AND TALL GRASS We will always do our best to clean your yard the best that we can. We understand that maintaining your yard is a lot of work and it may not always be in the best shape. The customer understands that it can be very difficult to find dog poop in tall grass or in a yard full of leaves or other debris. If your grass is tall when we come, there may be some dog waste that is missed. We will be back on our next scheduled visit and will get anything that was missed if yard maintenance is complete. Additional Fees:

• Cleaning/sanitizing decks/patios/sidewalks: $5/visit
• Come-back requests: $15/time
• Cleaning rocks/pebbled areas: $3/visit
• Waiting time: $5/visit
• Waste disposal surcharge: $5 per 5-gallon bucket if Super Duper Scoopers removes the waste from the premises.
• Excessive Grass Height/Excessive Yard Debris: $10/visit

Waste Disposal:

• Client Provided Waste Receptacle: Clients may provide their own waste receptacle for waste deposition after cleaning. The client must ensure the receptacle meets necessary hygiene standards and is accessible during scheduled visits.
• Super Duper Scoopers Waste Removal: Alternatively, for an additional surcharge of $5 per 5-gallon bucket, we will remove the waste from the premises. Communicate your preference regarding waste disposal prior to starting our services. Failure to do so will default to our waste removal option and applicable surcharge.

PRIVACY POLICY We may collect personal information from you on our Sites or through any other digital or personal communication with you. Information collected by us is voluntarily provided by you and may include information such as your name, email address, phone number, and physical address. Our Sites may collect general information about the service you are requesting such as the type of property and area needing service, the type and number of pets you have, and general information about your pet’s behavior. We collect information about you in order to provide you with our services. We use personal information about our users for a variety of purposes related to our business, your information is for Super Duper Scoopers use only. We will never sell your information or send it to third parties. We may provide user information to third-party service providers or vendors for purposes of, including without limitation, processing your payments or sending information to you, data tracking, maintenance or development of our System. We may also share your personal information in connection with law enforcement requests or in response to investigations, subpoenas, court orders, or other legal processes to establish or exercise our legal rights or defend against legal claims or as otherwise required by law.

REVISIONS Super Duper Scoopers provides the above Services to you subject to the Terms, which may be amended from time to time without notice to you. Amendments will be effective upon our posting of such updated Terms to our website. We recommend you visit the Sites to review any changes in our practices. Your continued use of our Services shall constitute acceptance to any changes to the Terms. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

SHUT DOWN We reserve the right to shut down operations fully between Christmas to New Years Day and including any Federally Recognized Holidays.

Hold Harmless Agreement with Liability Waiver:

The Customer agrees to indemnify and hold harmless Super Duper Scoopers, its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to the use of our pet waste removal services. The Customer acknowledges that Super Duper Scoopers shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the use or inability to use our services. The Customer understands and agrees that Super Duper Scoopers shall not be responsible for any claims, demands, or actions brought by any third party arising from or related to the Customer's use of our services. By accepting these Terms, the Customer expressly releases Super Duper Scoopers from any and all liability arising from the provision of our pet waste removal services, including but not limited to claims arising from negligence, breach of contract, or any other legal theory, to the fullest extent permitted by law.
